– The orientation for building high-tech zones is established and adjusted together with the formulation, appraisal, approval, and adjustment of regional planning in accordance with planning law.

In addition, Clause 1, Article 45 of Decree 10/2024/ND-CP provides as follows:

State management responsibilities of provincial-level People’s Committees

1. Propose contents of the orientation for building high-tech zones in regional planning; lead the development of the scheme for developing the high-tech zone system in provincial planning; direct implementation after regional and provincial plans are approved.

Accordingly, provincial-level People’s Committees are responsible for proposing and leading the orientation for building high-tech zones, and directing implementation after regional and provincial plans are approved.

What types of activities are conducted in high-tech zones?

Under Article 27 of Decree 10/2024/ND-CP, the types of high-tech activities in high-tech zones are as follows:

– High-tech research and development;

– High-tech application;

– High-tech incubation, incubation of high-tech enterprises;

– High-tech human resource training;

– High-tech fairs, exhibitions, and demonstrations, demonstrations of high-tech products resulting from high-tech research, application, and transfer;

– Production and trading of high-tech products;

– Provision of high-tech services.

What is the process for submitting to the Prime Minister the establishment or expansion of a high-tech zone?

Under Clauses 2 and 3, Article 8 of Decree 10/2024/ND-CP, the process and procedures for submitting to the Prime Minister the establishment or expansion of a high-tech zone are as follows:

(1) Process and procedures for establishing or expanding a high-tech zone:

– The provincial-level People’s Committee prepares the dossier as prescribed in Article 7 of Decree 10/2024/ND-CP and sends it to the lead agency for submission of the establishment or expansion of the high-tech zone as prescribed in Clause 1, Article 8 of Decree 10/2024/ND-CP;

– Within 05 working days from receipt of the complete dossier for the establishment or expansion of the high-tech zone as prescribed, the lead agency sends the dossier and a written request for opinions to relevant State agencies;

– Within 20 working days from receipt of the written request for opinions and the accompanying dossier, the consulted agency shall send written opinions on contents within the scope of its State management to the requesting agency;

– Within 05 working days from receipt of all written opinions, the lead agency for submission of the establishment or expansion of the high-tech zone evaluates and consolidates the dossier according to the corresponding contents in Clause 3, Article 8 of Decree 10/2024/ND-CP for the establishment or expansion of the high-tech zone.

+ Where necessary, the lead agency for submission of the establishment or expansion of the high-tech zone organises a meeting with relevant ministries, sectors, and the provincial-level People’s Committee, or establishes an advisory council to clarify relevant issues;

– During the dossier evaluation, where the dossier requires amendment or supplementation, the lead agency for submission of the establishment or expansion of the high-tech zone shall notify the provincial-level People’s Committee in writing for implementation. The time for amending and supplementing the dossier is not counted in the dossier evaluation time;

– Within 05 working days from receipt of the dossier requesting the establishment or expansion of the high-tech zone that has been amended and supplemented as required (if any), the lead agency for submission of the establishment or expansion of the high-tech zone prepares the dossier as prescribed in Clause 1, Article 9 of Decree 10/2024/ND-CP and submits it to the Prime Minister for consideration and decision on the establishment or expansion of the high-tech zone.

(2) Contents of the evaluation of the dossier for the establishment or expansion of a high-tech zone include:

– Legal basis and necessity of establishing or expanding the high-tech zone;

– Assessment of compliance with the conditions for establishing or expanding a high-tech zone as respectively prescribed in Article 6 of Decree 10/2024/ND-CP;

– Assessment of the feasibility of the development orientation of the high-tech zone; the plan for mobilising resources to invest in building the technical infrastructure system of the high-tech zone, the expanded part of the high-tech zone, and its connection with the infrastructure system of the already-invested high-tech zone; the ability to balance the State budget;

– Preliminary assessment of the effectiveness of contributions in science and technology and socio-economics of establishing or expanding the high-tech zone;

– Feasibility of the solutions for implementing the establishment or expansion of the high-tech zone.

What does the submission dossier for the establishment or expansion of a high-tech zone include?

Under Article 9 of Decree 10/2024/ND-CP, the submission dossier for the establishment or expansion of a high-tech zone is as follows:

The dossier prepared by the lead agency for submission of the establishment or expansion of the high-tech zone as prescribed in Clause 1, Article 8 of Decree 10/2024/ND-CP for the Prime Minister’s consideration and decision on the establishment or expansion of the high-tech zone includes:

– A submission to the Prime Minister by the lead agency for submission of the establishment or expansion of the high-tech zone on the establishment or expansion of the high-tech zone based on the dossier evaluation results (accompanied by the draft Decision on establishment or expansion and promulgation of the operation regulations of the high-tech zone);

– A submission to the Prime Minister on the request for establishment or expansion of the high-tech zone by the provincial-level People’s Committee (amended and supplemented if so required);

– The scheme for the establishment or expansion of the high-tech zone by the provincial-level People’s Committee (amended and supplemented if so required);

– Accompanying supporting documents (if any).

Decree 10/2024/ND-CP on high-tech zones took effect on 25/3/2024.
