When did the Ministry of Industry and Trade announce the group of 05 market-leading enterprises in the field of e-commerce?

Pursuant to Article 28a of Circular 47/2014/TT-BCT supplemented by Clause 5 Article 1 Circular 01/2022/TT-BCT regulates the announcement of the list of market leading enterprises in the field of e-commerce services as follows:

Accordingly, before March 15 every year, the Ministry of Industry and Trade announces the group of 05 leading enterprises in the market of the previous year.

In addition, published information includes:

– Name of trader or organization providing e-commerce services;

– Name of website or application providing e-commerce services.

In addition, according to the “Vietnam E-commerce Report 2023”, the group of 05 leading enterprises in the market in the field of e-commerce in 2023 are the following enterprises:

Group of 05 market-leading enterprises in the field of e-commerce Based on what factors are factors determined?

Pursuant to Article 67c of Decree 52/2013/ND-CP supplemented by Clause 24, Article 1, Decree 85/2021/ND-CP, regulating market access conditions for foreign investors in the field of e-commerce services such as: following:

2. Market access conditions include:

a) Foreign investors investing in and providing e-commerce services in Vietnam according to the provisions of Clause 1 and Clause 2, Article 21 of the Investment Law;

b) Foreign investors controlling 01 enterprise or more in the group of 05 leading enterprises in the e-commerce service market in Vietnam according to the list published by the Ministry of Industry and Trade must have national security appraisal opinions from the Ministry of Public Security.

4. The group of 05 leading enterprises in the market at Point b, Clause 2 of this Article is determined based on the criteria of number of visits, number of sellers, number of transactions, and total transaction value.

5. In the case specified in Point b, Clause 2 of this Article, the investor shall carry out the process of applying for and adjusting the Business License according to the Government’s regulations on goods purchase and sale activities and activities directly related to the purchase and sale of goods of foreign investors and foreign-invested economic organizations as follows:

a) During the process of giving opinions according to authority on the Dossier for issuance and adjustment of Business License, the Ministry of Industry and Trade shall send a document to request the opinion of the Ministry of Public Security;

b) Based on the written request of the Ministry of Industry and Trade, the Ministry of Public Security shall send a document clearly stating its approval or disapproval of the investor’s request to the Ministry of Industry and Trade within 20 days from the date of receipt of the written request from the Ministry of Industry and Trade;

c) Based on the opinion of the Ministry of Public Security, the Ministry of Industry and Trade shall issue a written response to the business license granting agency according to regulations;

d) The time limit for asking for opinions from the Ministry of Public Security is not included in the time limit for giving approval from the Ministry of Industry and Trade according to the provisions of law.

6. Investors with investment activities in innovative small and medium-sized start-up enterprises according to the provisions of law on supporting small and medium-sized enterprises do not have to comply with the provisions of Clause 2 of this Article.

Thus, the group of 05 market leading enterprises in the field of e-commerce is determined based on the criteria of:

– Number of visits,

– Number of sellers,

– Number of transactions,

– Total transaction value.

What are the tasks and powers of the Ministry of Industry and Trade regarding e-commerce and digital economy?

According to the provisions of Clause 18, Article 2 of Decree 96/2022/ND-CP, regarding e-commerce and digital economy, the Ministry of Industry and Trade has tasks and powers, specifically as follows:

– Implement state management of e-commerce.

Preside, coordinate, and organize the implementation of strategies, plans, and programs for e-commerce development, policies and laws regulating e-commerce activities;

– Organize and implement mechanisms to encourage, support and orient the development of new business models based on e-commerce applications and digital technology applications in the field of industry and trade;

– Guide and check the content and conditions of e-commerce activities; manage and supervise e-commerce activities and business models based on digital technology applications in accordance with the law;

– Establish and operate essential infrastructure for e-commerce;

+ Build an architectural framework and shared technical platform for business models based on digital technology applications in the field of industry and trade;

– Building and developing e-commerce infrastructure and applying digital technology in the industry and trade sector, supporting businesses to link through the value chain, developing markets to promote export activities;

– Implement state management of digital transformation in industries and fields under the ministry’s state management scope, develop digital economy of industry and trade.
