Latest procedures for registering an individual business household in 2024?

Business registration procedures for individual business households are carried out according to the provisions of Article 87 of Decree 01/2021/ND-CP as follows:

Place of business household registration: The district-level business registration authority where the business household’s headquarters is located, specifically according to the provisions of Article 14 Decree 01/2021/ND-CP, the district-level business registration authority is: Finance – Planning Department under the district People’s Committee.

Step 1:

Upon receiving the dossier, the district business registration authority will issue a receipt and issue a business household registration certificate to the business household within 03 working days from the date of receipt of the valid dossier.

In case the dossier is invalid, within 03 working days from the date of receipt of the dossier, the district business registration authority must notify the applicant or business household founder in writing. The notice must clearly state the reason and requests for document amendments and supplements (if any).

Step 2:

If after 03 working days from the date of submitting the application for household business registration, you do not receive the Certificate of household business registration or do not receive a notice requesting amendments or supplements to the household business registration dossier, the founder of the business household or business household has the right to complain and denounce according to the provisions of law on complaints and denunciations.

Step 3:

Periodically in the first working week of every month, the district-level Business Registration Authority sends a list of business households registered last month to the Tax Authority at the same level, the Business Registration Office and the provincial-level specialized management agency.

What documents are included in the business household registration dossier?

The business household registration dossier includes the documents prescribed in Clause 2, Article 87 of the Resolution Decree 01/2021/ND-CP as follows:

(1) Application for business household registration;

(2) Personal legal documents for business household owners and household members registering business households in case household members register business households;

(3) Copy of meeting minutes of household members on establishment of household business in case household members register business household;

(4) Copy of the household member’s authorization document for a member to own a business household in case household members register a business household.

How to pay the business household registration fee?

Pursuant to Article 5k supplemented by Clause 2, Article 1 of Circular 02/2023/TT-BKHDT and Article 5 of Circular 01/2021/TT-BKHDT, the payment of business household registration fees is as follows:

– The person submitting the business household registration application pays the business household registration fee at the time of submitting the business household registration application.

Business household registration fees can be paid directly at the department receiving business household registration applications at the district level or transferred to the account of the district business registration authority or using the online payment service on the National Public Service Portal.

The business household registration fee is not refundable to the business household in case the business household is not granted business household registration.

– The resolution of transaction errors arising during the use of online payment services on the National Public Service Portal is carried out in accordance with the provisions of law on resolving administrative procedures in the electronic environment and the Regulations on management, operation and exploitation of the National Public Service Portal.

Can business households conduct business in conditional business lines?

Pursuant to the provisions of Article 89 Decree 01/2021/ND-CP with content:

Business lines and lines of business households

1. When registering establishment or registering to change the content of business household registration, the business household must write the business line and profession on the Application for Business Household Registration and Notice of Change in Business Household Registration Content. The district business registration authority records information about business lines and professions on the Business Registration Certificate.

2. Business households are entitled to conduct business in conditional investment and business lines from the time they meet the conditions prescribed by law and must ensure that they meet those conditions throughout the operation process. State management of conditional investment and business industries and occupations and inspection of the compliance with business conditions of business households fall under the authority of specialized agencies according to the provisions of specialized laws.

3. In case the district-level Business Registration Authority receives a document from the competent authority regarding a business household conducting conditional investment and business lines but does not meet the conditions prescribed by law, the district-level Business Registration Authority shall issue a Notice requesting the business household to temporarily stop conducting business in the conditional investment and business lines, and at the same time notify the competent state authority to handle according to the provisions of law.

Thus, business households have the right to conduct business in conditional investment and business lines from the moment they meet the conditions prescribed by law and must ensure that they meet those conditions throughout the operation process.
