Land, Housing and Land Certificate (Sổ Đỏ) Advisory in Vietnam

ANT Legal provides legal advisory services on land, housing and land certificates (sổ đỏ) in Ho Chi Minh City and the southern region: from first-time issuance of land certificates, title transfer upon sale/purchase, gift or inheritance, parcel subdivision, change of land use purpose, to resolution of land and housing disputes. Every land parcel is tied to a specific cadastral file — accurate advice always begins with a review of the documents and the actual on-site conditions.

Common land and housing procedures

  • First-time issuance of the Certificate (sổ đỏ/sổ hồng) for land use rights, house ownership and other assets attached to land — under Decree No. 101/2024/ND-CP;
  • Registration of changes: title transfer upon sale, gift, inheritance, mortgage, capital contribution;
  • Parcel subdivision and consolidation; change of land use purpose (e.g. from agricultural land to residential land);
  • Extension of the land use term upon expiry;
  • Complaints and lawsuits in land disputes: boundary disputes, shared access paths, inheritance of land and houses.

Under the two-tier local government model (district level abolished from 1 July 2025), many land procedures are now handled at the commune level where the land is located or at the Land Registration Office — applicants must file with the correct competent authority to avoid files being passed back and forth.

Applicable legal framework

  • Land Law 2024 (Law No. 31/2024/QH15), effective 1 August 2024;
  • Housing Law 2023 (Law No. 27/2023/QH15), effective 1 August 2024;
  • Decree No. 101/2024/ND-CP on land registration and issuance of Certificates.

Documents usually required

Land use right certificate (if any); contracts or instruments of transfer/gift; personal identification documents of the parties; land origin records (land allocation decisions, old handwritten sale documents, etc.); tax and fee payment receipts; and documents evidencing stable land use (for first-time issuance).

Frequently asked questions

Can land purchased with a handwritten paper be issued a sổ đỏ?

Possibly, if the conditions for first-time issuance of the Certificate under the Land Law 2024 are met (stable use, no dispute, conformity with planning, etc.). However, such files are often complex and require a lawyer to review the land origin before filing.

How long does it take to obtain a sổ đỏ?

It depends on the type of procedure, the completeness of the file and the workload of the receiving authority. A complete file filed with the correct authority is processed significantly faster than one requiring repeated supplements.
