In what cases are foreigners allowed to play at prize-winning electronic game businesses?

Foreigners are allowed to play at prize-winning electronic game businesses in the cases specified in Article 9 of Decree 121/2021/ND-CP, with the following content:

Subjects allowed to play at Business Points

1. Foreigners and Vietnamese residing abroad legally enter Vietnam with a passport or valid international travel document issued by a competent foreign agency and have a valid period of residence in Vietnam.

2. The subjects specified in Clause 1 of this Article must be people with full civil capacity according to the provisions of Vietnamese law and voluntarily comply with the Game Rules and the provisions of this Decree.

Accordingly, foreigners are allowed to play at prize-winning electronic game businesses if they meet the following conditions:

– Legally enter Vietnam with a passport or valid international travel document.

– There is still a period of residence in Vietnam.

– Have full civil act capacity.

– Voluntarily comply with the Game Rules and legal regulations.

Are foreigners allowed to bring prize money in foreign currency abroad when winning at a prize-winning electronic game business?

Whether or not foreigners are allowed to bring prize money in foreign currency abroad when winning at a prize-winning electronic game business based on the provisions in Clause 1, Article 10 of Decree 121/2021/ND-CP, the content is as follows:

Player’s rights and obligations

1. Players have the following rights:

a) Have the business confirm and fully pay the prize when winning;

b) Receive the prize money and transfer or bring the prize money in foreign currency abroad in accordance with the regulations on foreign exchange management of Vietnamese law and the instructions of the State Bank of Vietnam;

c) Be required that the enterprise keep the winning information secret rewards and rewards;

d) Have the right to lodge complaints or lawsuits against the enterprise regarding bonus payment results; denounce acts of fraud and violations of this Decree and legal regulations;

d) Enjoy other legal rights as prescribed in the Game Rules announced by the enterprise.

According to the above regulations, foreigners are allowed to bring prize money in foreign currency abroad when winning at a prize-winning electronic game business but must comply with the regulations on foreign exchange management of Vietnamese law and the instructions of the State Bank of Vietnam.

Are foreigners allowed to use the results of electronic games with prizes at business locations for betting?

Are foreigners allowed to use the results of electronic games with prizes at business locations for betting other than the provisions in Clause 2, Article 10 of Decree 121/2021/ND-CP, the content is as follows:

Rights and obligations of players

2. Players have the following obligations:

a) Must bring documents to prove that they are eligible to play as prescribed in Article 9 of this Decree;

b) Be responsible for complying with the Game Rules, internal rules and relevant internal management regulations of the enterprise, and fully fulfilling tax obligations to the State according to the provisions of law;

c) Do not use the results of prize-winning electronic games at Business Points to bet directly with each other;

d) Must not cause insecurity, social order or safety at the business location;

d) Strictly comply with other relevant legal regulations.

Thus, foreigners are not allowed to use the results of electronic games with prizes at business locations for betting.

Can foreigners use foreign currency to exchange for conventional currency when participating in video games with prizes?

Foreigners can use foreign currency in cash to exchange for conventional currency when participating in electronic games with prizes or not, based on the provisions of Article 17 of Decree 121/2021/ND-CP, with the following content:

Management of payments and foreign exchange

1. Businesses are allowed to use Vietnamese Dong, foreign currency in cash, bank transfer, and players’ credit cards to exchange for conventional currencies when participating in prize-winning electronic games. Foreign currency receipts and expenditures of enterprises are carried out after being licensed by the State Bank of Vietnam according to the provisions of Chapter IV of this Decree.

2. Enterprises are allowed to collect foreign currency in cash and transfer money from prize-winning electronic game business activities and use this foreign currency cash and transfer to pay prizes to players when winning prizes and other foreign exchange activities after being licensed by the State Bank of Vietnam according to the provisions of Chapter IV of this Decree.

Thus, foreigners can use foreign currency in cash to exchange for conventional currency when participating in prize-winning electronic games.
