1. What are the conditions for trading veterinary drugs?

Pursuant to Article 92 of the Law on Veterinary Medicine 2015, which stipulates the conditions for trading veterinary drugs as follows:

“Article 92. Conditions for trading veterinary drugs

Organizations and individuals trading veterinary drugs must ensure the following conditions here:

1. Have a Business Registration Certificate or Enterprise Registration Certificate;

2. Have a suitable location, physical and technical facilities;

3. The manager and person directly selling veterinary drugs must have a Veterinary Practice Certificate;

4. Have a Certificate of eligibility to trade veterinary medicine.”

2. Does acting as an agent for a veterinary drug store need to ensure the same conditions as selling veterinary drugs?

Pursuant to the provisions of Article 166 of the 2005 Commercial Law on commercial agents as follows:

“Article 166. Commercial agencyCommercial agency is a commercial activity in which the principal is an agent. and the agent agrees that the agent will buy and sell goods on its own behalf for the principal or provide the principal’s services to customers to receive remuneration.”
Pursuant to the provisions of Article 167 of the 2005 Commercial Law on principals and agents as follows:
“Article 167. Principal and agent agent1. An agent is a trader who delivers goods to a selling agent or delivers money to buy goods to a buying agent or is a trader who authorizes the performance of services for a service provision agent.2. An agent is a trader who receives goods to act as a selling agent, receives payment for goods to act as a buying agent or is an authorized party to provide services.As Therefore, being an agent for a veterinary medicine store is essentially the business of buying and selling veterinary medicine, so being an agent for this item requires ensuring the same conditions as trading veterinary medicine.

3. What do you need to do to become a veterinary medicine dealer?

As mentioned above, agents selling veterinary drugs need to ensure the conditions in Article 92 of the Law on Veterinary Medicine 2015, accordingly, agents need to have a Business Certificate, which will include all conditions for trading veterinary drugs and the order and procedures for granting certificates according to Article 97 of the Law on Veterinary Medicine 2015 as follows:
“Article 98. Order and procedures for issuance, re-issuance and revocation of Certificates of eligibility to import veterinary drugs
1. Application dossier for issuance of Certificate of eligibility to import veterinary drugs includes:
a) Registration form;
b) A detailed explanation of the physical and technical facilities;
c) Enterprise registration certificate or Business registration certificate;
d) Veterinary practice certificate.
2. Order and procedures for issuance of Certificate of eligibility to import veterinary drugs:
a) Organizations and individuals importing veterinary drugs submit application documents for issuance of Certificate of eligibility to import veterinary drugs to the Department of Animal Health;
b) Within 10 days from the date of receipt of valid documents, the Department of Animal Health shall check the conditions of the facility importing veterinary drugs. If qualified, within 03 working days from the date of completion of the inspection, a Certificate of eligibility to import veterinary drugs must be issued; In case of refusal, a written response must be made clearly stating the reason.
3. Documents, order and procedures for reissuing the Certificate of eligibility to import veterinary drugs in case of loss, error or damage; Change information related to registered organizations and individuals:
a) The re-issue registration dossier includes the re-issue application; Documents proving the changed content in case of changing information related to the registered organization or individual; Certificate of eligibility to import veterinary drugs has been issued, unless lost;
b) Organizations and individuals submit applications to re-issue the Certificate of eligibility to import veterinary drugs to the Department of Animal Health; Within 05 working days from the date of receipt of valid documents, the Department of Animal Health will re-issue the Certificate of eligibility to import veterinary drugs; In case of refusal, a written response must be made clearly stating the reason.
4. The Department of Animal Health revokes the Certificate of eligibility to import veterinary drugs of organizations and individuals importing veterinary drugs in the following cases:
a) The certificate of eligibility to import veterinary drugs is erased or the content is edited;
b) Violating the law and being administratively sanctioned three or more times in a year or being administratively sanctioned three times in a row for a violation in the field of importing veterinary drugs;
c) No longer carrying out veterinary drug import activities;
d) Committing other violations that require revocation of the Certificate of sufficiency by law; Conditions for importing veterinary drugs.”
