1. What are prize-winning video games? What is a prize-winning video game business?
According to Clause 1, Article 2 of Decree 121/2021/ND-CP, prize games are games of chance held on electronic game machines with prizes in which players spend money to participate and can win monetary prizes.
In addition, according to Clause 2, Article 2 of Decree 121/2021/ND-CP, the business of prize-winning games is a conditional business activity licensed by a competent state management agency to operate prize-winning games on prize-winning electronic game machines (however, this definition only applies to foreigners).
2. Who will be able to play prize-winning video games?
Subjects allowed to play prize-winning electronic games are specifically regulated in Article 9 of Decree 121/2020/ND-CP as follows:
– Foreigners and Vietnamese residing abroad legally enter Vietnam with a passport or valid international travel document issued by a competent foreign agency and have a valid period of residence in Vietnam.
– The subjects specified in Clause 1 of this Article must be people with full civil capacity according to the provisions of Vietnamese law and voluntarily comply with the Game Rules and the provisions of this Decree.
Thus, Vietnamese people are still eligible to participate in prize-winning video games (with the condition that they must reside abroad and legally enter Vietnam) and foreigners. Vietnamese people residing in Vietnam are not eligible to participate in prize-winning video games.
3. Who are allowed to enter and exit the prize-winning electronic game business?
The following subjects are allowed to enter and exit the prize-winning electronic game business according to Clauses 1 to 5, Article 11 of Decree 121/2020/ND-CP as follows:
– Subjects allowed to play as prescribed in Article 9 of this Decree.
– Managers and employees of the enterprise are allowed to enter and leave the Business Point to work as assigned by the enterprise. Enterprises must prepare and publish an updated list of managers and employees of the enterprise who are allowed to leave and enter to work at the Business Location.
– Employees of service providers who have signed a contract to provide services to the enterprise are allowed to enter and exit the Business Location to work as assigned by the enterprise. Enterprises must prepare and publish an updated list of employees of service providers who have signed a contract to provide services to the enterprise and are allowed to enter and exit to work at the business location.
– Officials and civil servants of competent state management agencies assigned to carry out inspections and inspections of enterprises according to the provisions of law.

4. How are the rights and obligations of video game players usually regulated?
The rights and obligations of players of video games with prizes are stipulated in Article 10 of Decree 121/2020/ND-CP as follows:
– Players have the following rights:
+ Be fully confirmed and compensated by the enterprise when winning a prize;
+ To receive prize money and transfer or bring prize money in foreign currency abroad according to the regulations on foreign exchange management of Vietnamese law and instructions of the State Bank of Vietnam;
+ To request the enterprise to keep the winning and prize receipt information confidential;
+ To have the right to complain and sue the enterprise about the payment results reward; denounce acts of fraud and violation of the provisions of this Decree and the law;
+ Enjoy other legal rights as prescribed in the Game Rules announced by the enterprise.
– Players have the following obligations:
+ Must bring documents to prove that they are eligible to play as prescribed in Article 9 of this Decree;
+ Be responsible for complying with the Game Rules, internal rules and relevant internal management regulations of the enterprise, and fully fulfill tax obligations to the State according to the provisions of law;
+ Do not use the results of prize-winning electronic games at Business Points to bet directly with each other;
+ Do not cause insecurity or disorder. order, social safety at the business location;
+ Strictly comply with other relevant legal regulations.
