– By 2025:

+ Consulting and supporting the establishment of at least 250 new cooperatives and 1,500 cooperatives in agriculture; Consolidate and improve the quality and operational efficiency of at least 750 agricultural cooperatives mobilized, guided and supported to be established by Farmers’ Associations at all levels.

From what sources does the funding for implementing the Project “Vietnam Farmers’ Association participate in collective economic development in agriculture until 2030” come from?

Pursuant to Clause 4, Article 1, Decision 182/QD-TTg 2024 stipulates the funding for implementing the Project as follows:

a) Funding sources for implementing the Project include:

– Central budget capital: Arranged in the annual regular expenditure budget estimates for agencies implementing the Project and integrated from the Program to support the development of the market economy and cooperatives; National target programs for the period 2021 – 2025 and 2026 – 2030; other related programs and projects.

– Local budget capital.

– Credit capital (including: Credit capital from the Bank for Social Policies, Cooperative Development Support Fund, Farmer Support Fund according to the provisions of law).

– Capital mobilized by businesses, cooperatives, cooperatives, and households.

– Other legally mobilized capital sources.

b) Funds for managing and supervising the implementation of the Project: Deducted from the state budget allocated for regular expenditures and capital for implementing national target programs assigned annually to all levels of Farmers’ Associations.

c) Financial mechanism of the Project: Follow the provisions of law on state budget and financial mechanisms of national target programs, related programs, schemes and projects.

Thus, funding for implementing the Project is taken from sources such as central budget capital, local budget capital, credit capital, capital from enterprises, cooperatives, cooperatives, self-mobilized households and other legally mobilized capital sources.

What does a cooperative establishment dossier include?

Pursuant to Article 7 of Circular 03/2014/TT-BKHDT amended by Clause 2, Article 2, Circular 07/2019/TT-BKHDT, regulates the registration of cooperatives as follows:When establishing a cooperative, the cooperative sends to the cooperative registration agency where the cooperative intends to have its headquarters a set of documents to register the establishment of the cooperative, including:

– Application for registration of establishment of cooperative;

– The cooperative’s charter is drawn up;

– Production and business plan;

– List of members;

– List of board of directors, director (general director), control board or controllers

– The resolution of the founding conference on the contents specified in Clause 3, Article 20 of the 2012 Cooperative Law was voted for.

Cooperatives have legal status and have the right to operate according to the content in the cooperative registration certificate from the date the cooperative registration certificate is issued. After being granted a registration certificate, the cooperative has its seal engraved and has the right to use its seal.

In case a registration certificate is not issued, the cooperative registration agency shall notify the cooperative in writing and clearly state the reason for the cooperative.

However, in the near future, the composition of the application for registration of establishing a cooperative will be changed according to legal regulations as follows.

Pursuant to Clause 2, Article 42 of the Cooperative Law 2023, the application for registration of establishment of a cooperative includes:

– Application for establishment registration;

– Charter;

– Resolution of the establishment conference;

– List of official members and capital contributing members;

– List and personal identification numbers of Vietnamese legal representatives; list and copies of legal documents of foreign legal representatives;

– Copy of investment registration certificate as prescribed in Point b, Clause 1, Article 30 of the Cooperative Law 2023;

– Copy of investment registration certificate for the project to establish cooperatives and unions of cooperatives in case the cooperatives and unions of cooperatives are established by individuals who are foreign investors or economic organizations with foreign investment capital according to the provisions of law on investment.

The Cooperative Law 2023 takes effect from July 1, 2024, except for the provisions in Clause 3 and Clause 4, Article 115 of the Cooperative Law 2023, which takes effect from September 1, 2023.
