Debt Recovery Advisory
The longer an overdue debt is left, the harder it becomes to collect: the debtor delays, dissipates assets, or even dissolves the business. Effective debt recovery is a strategic process — from negotiation leverage to strong legal measures — not just “sending a few demand letters.”
The 3-Stage Debt Recovery Process
- Negotiation stage (0–30 days): reviewing the debt dossier (contracts, debt reconciliation minutes, delivery/payment records); sending an official demand letter with a payment deadline; negotiating a secured installment plan (asset mortgage, guarantee). A lawyer’s demand letter usually carries greater psychological pressure than an internal document.
- Litigation stage (when negotiation fails): filing a lawsuit with the Court or Arbitration as agreed in the contract; while considering a request for interim emergency measures (seizure, account freezing) to preserve assets. See Debt Collection Lawsuit Advisory.
- Enforcement stage: when there is an effective judgment/award, requesting the enforcement agency to organize enforcement; coordinating in verifying the judgment debtor’s assets. See Civil Judgment Enforcement Advisory.
Prerequisite: The Debt Dossier Must Be “Clean”
- Contracts, appendices, and purchase orders with complete signatures and seals;
- Goods/service delivery minutes; debt reconciliation minutes confirmed by both parties;
- Partial payment records (if any); emails and messages acknowledging the debt;
- Limitation period for lawsuits still valid: 2 years for commercial disputes (Article 319 of the Commercial Law 2005), 3 years for civil disputes (Article 184 of the Civil Procedure Code 2015).
When to Escalate to Strong Legal Measures?
When the debtor: deliberately delays after repeated reminders; shows signs of asset dissipation; denies the debt despite clear evidence; or the limitation period is about to expire. In these cases, delaying litigation means voluntarily reducing the chances of recovery.
