Short answer: A person holding an Asset Management Officer practicing certificate registers to practice as an individual at the Department of Justice where he/she wishes to practice (submitting directly or online). The dossier includes the application using form TP-QTV-06 and a copy of the practicing certificate; the Department of Justice resolves the matter within 05 working days. The current regulation is Decree No. 65/2026/ND-CP (effective from 01/3/2026, replacing Decree No. 22/2015/ND-CP).
What Forms of Practice Are Available to Asset Management Officers?
Under Article 12 of Decree No. 65/2026/ND-CP, Asset Management Officers practice in one of two forms:
- Practicing as an individual;
- Practicing within an asset management and liquidation enterprise by establishing, participating in the establishment of, or working under contract for an asset management and liquidation enterprise.
Note: at the same time, a person holding an Asset Management Officer practicing certificate may register only one form of practice.
Conditions for Being Granted an Asset Management Officer Practicing Certificate
It is necessary to clearly distinguish certificate issuance conditions from practice registration procedures: only after being granted the Asset Management Officer practicing certificate may an individual register to practice. Under Article 5 of Decree No. 65/2026/ND-CP and the Law on Recovery and Bankruptcy 2025, the issuance conditions include: being a lawyer, auditor, or a person with a bachelor’s degree in law, economics, accounting, finance, or banking with 05 or more years of experience in the trained field; having full civil act capacity; having good moral character; and having completed the Asset Management Officer professional training course as prescribed.
Where to Register to Practice as an Individual Asset Management Officer?
Under Article 13 of Decree No. 65/2026/ND-CP, a person holding an Asset Management Officer practicing certificate registers to practice asset management and liquidation as an individual at the Department of Justice where he/she wishes to practice, submitting 01 set of dossiers directly or online. A person registering to practice as an individual must have a transaction address.
What Does the Practice Registration Dossier Include?
Under Article 13 of Decree No. 65/2026/ND-CP, the dossier for registering to practice asset management and liquidation as an individual includes:
- The application for registration to practice asset management and liquidation as an individual using form TP-QTV-06 issued together with Decree No. 65/2026/ND-CP;
- A copy of the Asset Management Officer practicing certificate in valid form.
Where the dossier is submitted directly, the applicant presents the original certificate for comparison. Where necessary, the Department of Justice may request submission of a criminal record certificate.
Order and Procedures for Practice Registration
Under Article 13 of Decree No. 65/2026/ND-CP:
- Step 1: the person holding the Asset Management Officer practicing certificate submits 01 set of dossiers directly or online to the Department of Justice where he/she wishes to practice;
- Step 2: within 05 working days from receipt of a complete and valid dossier, the Department of Justice decides to record the applicant in the list of Asset Management Officers and asset management and liquidation enterprises and notifies in writing; in case of refusal, it must notify the reasons in writing. A refused person has the right to file complaints or lawsuits as prescribed;
- Step 3: a person recorded in the list may practice asset management and liquidation from the date the Department of Justice decides the recording. Asset Management Officers practice throughout the territory of Vietnam.
Notes on Applying Current Legal Regulations
Decree No. 22/2015/ND-CP (form TP-QTV-04, 07-working-day period) expired on 01/3/2026; Decree No. 65/2026/ND-CP now applies (form TP-QTV-06, 05-working-day period).
