Dossier for Issuance of the Asset Management Officer Practicing Certificate

An asset management officer is an individual practicing the management and liquidation of assets of an enterprise or cooperative that is insolvent in the course of bankruptcy resolution (Clause 7, Article 4 of the Law on Recovery and Bankruptcy No. 142/2025/QH15, effective from 01/03/2026).

1. Standards for issuance of the Asset Management Officer practicing certificate

Under Article 5 of Decree 65/2026/ND-CP (detailing the implementation of the Law on Recovery and Bankruptcy 2025 on asset management officers, effective from 01/03/2026), a person meeting all of the following standards is considered for issuance of the Asset Management Officer practicing certificate:

  • Being a Vietnamese lawyer or auditor; a foreign lawyer or foreign auditor permitted to practice in Vietnam; or a person holding a bachelor’s, master’s or doctoral degree in law, economics, accounting, finance or banking with at least 05 years of working experience in the trained field;
  • Having completed the Asset Management Officer vocational training course.

2. Cases in which the Asset Management Officer practicing certificate is not granted

Under Decree 65/2026/ND-CP, the certificate is not granted to a person being prosecuted for criminal liability, a person convicted but not yet having the criminal record expunged, a person being subject to administrative handling measures, a person who has lost or has limited civil act capacity, a person who is a cadre, civil servant or public employee (except as otherwise prescribed by law), or an officer or soldier in the armed forces.

3. Dossier for issuance of the Asset Management Officer practicing certificate

Under Decree 65/2026/ND-CP, the dossier for issuance of the Asset Management Officer practicing certificate follows the detailed provisions of this decree and is submitted to the provincial or centrally-run city Department of Justice where the applicant resides or works. The applicant should prepare the application in the prescribed template, documents proving the practicing standards (lawyer card, auditor certificate, or professional diplomas with confirmation of work experience), the certificate of completion of the Asset Management Officer vocational training course, and personal documents as prescribed.

Notes on application

From 01/03/2026, the Law on Bankruptcy 2014 ceased to be effective and was replaced by the Law on Recovery and Bankruptcy 2025; Decree 65/2026/ND-CP is the current guidance on asset management officers. The provisions of Decree 22/2015/ND-CP (issued to guide the Law on Bankruptcy 2014) are no longer the applicable basis for new issuance of practicing certificates.

Common risks to note

  • Submitting the dossier under old templates and regulations, resulting in return for supplementation;
  • Not having completed the Asset Management Officer vocational training course under the new program;
  • Confusing the conditions for practicing as an asset management officer with those for practicing as a lawyer or auditor.
