1. What is a business household?
Article 79 of Decree No. 168/2025/ND-CP provides:
(1) A business household is registered and established by an individual or family household members and is liable with all of its assets for the business activities of the household. Where family household members register a business household, they authorize one member to act as the representative of the business household. The individual registering the business household, or the person authorized by family household members to act as the representative of the business household, is the business household owner.

(2) Family households engaged in agricultural, forestry, fishery production, salt making, and itinerant vendors, snack sellers, traveling traders, mobile businesses, seasonal businesses, and low-income service providers are not required to register a business household, except where they conduct conditional investment business sectors. The People’s Committee of a province or centrally-affiliated city shall prescribe the low-income threshold applicable within the locality.
2. Principles applied in business household registration
Article 84 of Decree No. 168/2025/ND-CP provides:
(1) The business household and the business household founder shall self-declare the business household registration dossier and bear responsibility before the law for the lawfulness, truthfulness, and accuracy of the declared information in the business household registration dossier.
(2) The Commune-level Business Registration Office is responsible for the validity of the business household registration dossier, and is not responsible for violations of law by the business household founder or the business household.
(3) The Commune-level Business Registration Office does not resolve disputes between individuals within the business household or between them and other organizations or individuals.
(4) The business household owner may authorize other organizations or individuals to carry out business household registration procedures as prescribed in Article 12 of this Decree.
3. May a lost Business Household Registration Certificate be re-issued?
Article 94 of Decree No. 168/2025/ND-CP regulates the re-issuance of the Business Household Registration Certificate specifically:
(1) Where the Business Household Registration Certificate is lost, burned, torn, damaged, or destroyed in another form, the business household may send a written request for re-issuance of the Business Household Registration Certificate to the Commune-level Business Registration Office where the business household’s head office is located. The Commune-level Business Registration Office shall consider re-issuing the Business Household Registration Certificate within 03 working days from the date of receipt of the written request.
(2) The handling of cases where the Business Household Registration Certificate was issued inconsistent with the dossier, procedures, or processes as prescribed shall be carried out as follows:
a) Where the Business Household Registration Certificate was issued inconsistent with the prescribed procedures, the Commune-level Business Registration Office shall send a notice to the business household and re-issue it in accordance with the prescribed procedures;
b) Where the establishment registration of the business household was issued inconsistent with the prescribed dossier, the Commune-level Business Registration Office shall notify that the Business Household Registration Certificate issued inconsistent with the prescribed dossier is invalid, and require the business household to complete and submit a valid dossier as prescribed within 30 days from the date of sending the notice for consideration for issuance of the Business Household Registration Certificate. The business household may combine the lawful changes from subsequent change registrations into one dossier to be issued a new change registration at once;
c) Where the change of business household registration contents was issued inconsistent with the prescribed dossier, the Commune-level Business Registration Office shall notify that the Business Household Registration Certificate issued on the basis of a dossier inconsistent with the prescribed dossier is invalid, and at the same time issue the Business Household Registration Certificate based on the most recent valid dossier. The Commune-level Business Registration Office shall send a notice requiring the business household to complete and submit a valid dossier as prescribed within 30 days from the date of sending the notice for consideration for issuance of the Business Household Registration Certificate. The business household may combine the lawful changes from subsequent change registrations into one dossier to be issued a new change registration at once.
(3) The handling of cases where the Business Household Registration Certificate was issued on the basis of untruthful or inaccurate declared information in the business household registration dossier shall be carried out as follows:
a) Where the declared information in the business household establishment registration dossier is untruthful or inaccurate, the Commune-level Business Registration Office shall notify the competent State authority for handling in accordance with the law, and at the same time notify that the Business Household Registration Certificate issued on the basis of a registration dossier with untruthful or inaccurate declared information is invalid, and require the business household to complete and re-submit the dossier as prescribed within 30 days from the date of sending the notice for consideration for issuance of the Business Household Registration Certificate. The business household may combine the lawful changes from subsequent changes into one dossier to be issued a new change registration at once.
Where the business household does not complete and re-submit the dossier as prescribed, the Commune-level Business Registration Office shall require the business household to report as prescribed in Clause 6, Article 16 of this Decree;
b) Where the declared information in the dossier for registering changes to business household registration contents is untruthful or inaccurate, the Commune-level Business Registration Office shall notify the competent State authority for handling in accordance with the law, and at the same time notify that the Business Household Registration Certificate issued on the basis of a registration dossier with untruthful or inaccurate declared information is invalid, and issue the Business Household Registration Certificate based on the most recent valid dossier. The Commune-level Business Registration Office shall send a notice requiring the business household to complete and re-submit the dossier as prescribed within 30 days from the date of sending the notice for consideration for issuance of the Business Household Registration Certificate. The business household may combine the lawful changes from subsequent registrations and change notifications into one dossier to be issued a new change registration at once.
(4) Where a business household is issued a new Business Household Registration Certificate, the Business Household Registration Certificates of previous issuances are no longer valid.
Accordingly, when the Business Household Registration Certificate is lost, it will be re-issued.
