Name a business household according to the law

1. What standards are required for business household registration documents?

Pursuant to Article 87 of Decree 01/2021/ND-CP regulating specific business household registration:

(1) Business household registration is done at the district business registration authority where the business household’s headquarters is located.

(2) Business household registration dossier includes:

a) Application for business household registration;

b) Personal legal documents for business household owners and household members registering business households in case household members register business households;

c) Copy of minutes of meeting of household members on establishing a business household in case household members register a business household;

d) Copy of the household member’s authorization document for a member to be the business owner in case household members register a business household.

(3) Upon receiving the dossier, the District Business Registration Authority shall issue a Receipt and issue a Certificate of Business Registration to the business household within 03 working days from the date of receipt of the valid dossier.

In case the dossier is invalid, within 03 working days from the date of receipt of the dossier, the District Business Registration Authority must notify in writing the applicant or the person establishing the business household. The notice must clearly state the reason and requests for record amendments and supplements (if any).

(4) If after 03 working days from the date of submitting the application for business household registration, you do not receive the Business Household Registration Certificate or do not receive a notice requesting amendments or supplements to the business household registration dossier, the person who established the business household or business household has the right to complain and denounce according to the provisions of law on complaints and denunciations.

(5) Periodically on the first working week of every month, the district-level Business Registration Authority sends a list of business households registered last month to the Tax Authority at the same level, the Business Registration Office and the provincial specialized management agency.

At Article 85 of Decree 01/2021/ND-CP Regulations on the number of business household registration documents are as follows:

(1) The founder of a business household or business household submits 01 set of documents at the district business registration authority when carrying out business household registration procedures.

(2) The district business registration authority is not allowed to request the founder of a business household or business household to submit additional documents or papers other than those in the business household registration dossier as prescribed.

2. How to properly name a business household?

According to Article 88 of Decree 01/2021/ND-CP it is specifically understood as follows:

(1) Business households have their own names. The name of a business household includes two elements in the following order:

a) The phrase “Household business”;

b) The personal name of the business household.

The personal name is written with letters in the Vietnamese alphabet, the letters F, J, Z, W, and can be accompanied by numbers and symbols. sign.

(2) Do not use words or symbols that violate the historical, cultural, ethical and fine customs traditions of the nation to name a business household.

(3) Business households must not use the phrases “company” or “enterprise” to name a business household.

(4) A business household’s personal name cannot be used. must be the same as the personal name of the registered business household within the district level.

3. What is the business household registration code?

According to Article 83 of Decree 01/2021/ND-CP regulations:

(1) The district-level business registration authority records the business household registration code on the Business Household Registration Certificate according to the following structure:

a) Provincial code: 02 numerical characters;

b) District-level code: 01 character in Vietnamese letters;

c) Type code: 01 characters, 8 = business household business;

d) Business household serial number: 06 numeric characters, from 000001 to 999999.

(2) Newly established districts, towns, and provincial cities after the effective date of this Decree will have the next code inserted, in the order of the Vietnamese alphabet.

(3) In case of splitting a district, town, or provincial city after the effective date of this Decree, the split unit retains its old code and the split unit has the next code inserted, in the order of the Vietnamese alphabet.

(4) The Department of Planning and Investment notifies in writing the Ministry of Planning and Investment of the new code of the newly established or separated district. In addition, Article 84 of Decree 01/2021/ND-CP stipulates the principles applied in business household registration as follows:

(1) Business households and business household founders declare themselves in the business household registration dossier and are responsible before the law for the legality, truthfulness and accuracy of the information declared in the business household registration dossier.

(2) The district business registration authority is responsible for the validity of the business household registration dossier and is not responsible for violations of the law by business household founders or business households.

(3) The district business registration authority does not resolve disputes between individuals in business households with each other or with other organizations or individuals.

(4) The business household owner may authorize other organizations or individuals to carry out business household registration procedures as prescribed in Article 12 of this Decree.
