Call for and mobilize voluntary contributions

When natural disasters, epidemics, or incidents occur that cause damage to people, property, or affect people’s lives, depending on the level and scope of the damage, calling and soliciting voluntary contributions from organizations is carried out in the following ways:

5. Enterprises, cooperatives and other organizations with legal status call for and mobilize organizations and individuals to make voluntary contributions to overcome difficulties caused by natural disasters, epidemics and incidents. When mobilizing voluntary contributions, organizations must notify on the website or media a commitment to the purpose, scope, method, form of mobilization, objects of support, duration of support and send it in writing to the People’s Committee of the commune where the head office is located according to the Notice form issued with this Decree. Commune-level People’s Committees are responsible for storing, monitoring and providing information upon request from organizations and individuals contributing or receiving support and competent agencies serving the work of guiding, monitoring, inspecting, supervising and handling violations.

Thus, according to the law, when cooperatives mobilize voluntary contributions, they must notify them on their website or media.

To receive charitable contributions, cooperatives can open their own accounts at commercial banks as prescribed in Article 9 of Decree 93/2021/ND-CP as follows:

7. Enterprises, cooperatives and other organizations with legal status open a separate account at the State Treasury or commercial banks for each campaign to receive and manage all mobilized voluntary contributions according to the committed content, provisions of this Decree and relevant laws; There are receipts of voluntary contributions in cash and in kind received when requested by contributing organizations or individuals. Organizations are not allowed to receive additional voluntary contributions after the end of the committed reception period and are responsible for notifying the place where the account is opened (State Treasury or commercial bank) about stopping receiving voluntary contributions.

Thus, according to the regulations on receiving and managing voluntary contributions, the cooperative opens a separate account at a commercial bank for each campaign to receive and manage all mobilized voluntary contributions according to the committed content and provisions of law.

How are cooperatives responsible for distributing and using voluntary contributions?

Cooperatives are responsible for distributing and using voluntary contributions as prescribed in Article 10 of Decree 93/2021/ND-CP as follows:

6. For voluntary contributions mobilized and received by enterprises, cooperatives and other organizations with legal status, the following procedures are implemented:

a) Enterprises, cooperatives and other organizations with legal status are responsible for notifying the People’s Committee where they receive support (provincial, district, and commune levels according to decentralization; in case of necessity, contact the Provincial People’s Committee for specific instructions) to coordinate in determining the scope of support. vi, subjects, level, time of support and implementation of distribution, use of mobilized voluntary contributions, and incentive spending according to the contents specified in Clause 1, Article 11 of this Decree, except in cases of implementation according to commitments with contributing organizations and individuals specified in Clause 5, Article 6 of this Decree. Funds mobilized and received with conditions and specific addresses must be implemented in accordance with commitments and regulations in this Decree;

b) Within 03 working days at the latest from receiving the notification, the People’s Committee of the place receiving support shall preside over and coordinate with the Advocacy Committee at the same level (if any) to guide businesses, cooperatives and other organizations with legal status on the scope, subjects, level of support, time to distribute voluntary contributions and create conditions and ensure safety for support activities; appoint coordinating forces to participate in distributing voluntary contributions when necessary or at the request of businesses, cooperatives, and other organizations with legal status;

Thus, according to the regulations on distribution and use of voluntary contributions, cooperatives are responsible for notifying the People’s Committee where they receive support to coordinate in determining the scope, subjects, levels, and duration of support and implementing the distribution and use of mobilized voluntary contributions and encouraging spending according to the prescribed contents.
