Does the application dossier for a credit rating business eligibility certificate need to include the website address?

Yes. Under Article 17 of Decree 88/2014/ND-CP (on credit rating services — still in force), the Certificate of satisfaction of business conditions for a credit rating enterprise contains the following basic contents:

  • Name of the credit rating enterprise;
  • Head office address and website address of the credit rating enterprise;
  • Number and issuance date of the Enterprise Registration Certificate;
  • Number and issuance date of the Certificate of satisfaction of business conditions;
  • Other contents as prescribed.

Accordingly, the application dossier for the Certificate must fully state the website address of the enterprise.

Within how long does the Ministry of Finance notify on the completeness and validity of the dossier?

Under Article 16 of Decree 88/2014/ND-CP on the process and procedures for granting the Certificate of satisfaction of business conditions for credit rating enterprises:

  • The enterprise submits 01 set of the application dossier for the Certificate to the Ministry of Finance for checking completeness and validity;
  • Within 10 working days from receipt of the dossier, the Ministry of Finance notifies on the completeness and validity of the dossier and requests the enterprise to supplement documents (if any), and at the same time requests 05 sets of the official dossier for appraisal.

Upon re-issuance of the Certificate, must the number of re-issuances be recorded?

Yes. Under Article 17 of Decree 88/2014/ND-CP, the Certificate of satisfaction of business conditions, when re-issued, must clearly state the number of re-issuances in its contents.
